Wie geht es bei der EU weiter mit Schadensersatz in Kartellfällen?

Almunia, in der EU-Kommission zuständig für Wettbewerb und Beihilfen, hat den Fahrplan der Europäischen Kommission kürzlich in einer Rede skizziert.

  • Im Herbst 2010 wird es eine öffentliche Konsultation zu einem allgemeinen Rechtsrahmen geben, gemeinsam durch die drei Generaldirektionen Wettbewerb, Gesundheit und Verbraucherschutz sowie Justiz.
  • Darauf aufsetzend wird die Kommission dann sektorspezifische (z.B. kartellrechtliche) Instrumente entwickeln.

In particular, our goal is to define common legal principles to guide any future sector-specific legislative proposal on collective action. We intend to conduct a joint public consultation on the issue next fall.

After the consultation, the Commission take a position on this framework, that is the basis of concrete legislative proposals, such as on claims for breach of Community rules on competition.

I hope that in the end find a solution that can be applied in legal cultures in all Member States and to ensure real access to justice for all European consumers and companies harmed by anticompetitive behavior.
