Monopolization as a Basis for Business Litigation

Presented by the Civil Practice & Procedure, International and Unilateral Conduct Committees

Using a hypothetical case involving dominance/monopoly power, mock jurors will deal with the requirement to present evidence that the defendant acted illegally. The panel will explore the difficulties plaintiffs face when they have to rely on monopolization as a theory of harm and litigation pitfalls from the perspective of both the U.S. and the EU.
