Neues OECD-Papier zur kartellrechtlichen Bewertung von “resale price maintenance” (RPM, Preisbindung der zweiten Hand)

Das Papier (307 Seiten) fasst im Wesentlichen einen Roundtable zusammen, den die OECD im Jahr 2008 abgehalten hat. 

Es enthält unter anderem ein Übersicht über die Rechtslage in 20 OECD-Staaten.

Aus der Zusammenfassung, S. 9:

There remain significant differences of opinion within and across countries on the approach that competition policy should take to resale price maintenance. Economists, together with the business community, have tended to oppose a strict or “per se” approach to RPM. Economists recognize that RPM may, in certain circumstances, facilitate collusion. But, at the same time, they have for many years argued that resale price maintenance is, in many cases, benign and often procompetitive. As a result, most economists argue that RPM should not be per se illegal, but should be analysed under a “rule of reason” approach which allows weighing of potential anti-competitive effects with potential efficiency benefits.
